LIMITED WARRANTY AND LIMITATION OF REMEDIES

MSA-2000, Inc. warrants the disks, CD or other media, including electronically transmitted material containing the licensed software to be free from defects in materials and workmanship under normal use by the original purchaser for 90 days from the date of purchase. Within the 90 day period, MSA-2000, Inc. will replace defective disk(s) without charge. The entire liability of MSA-2000, Inc. and its suppliers and the customer’s sole and exclusive remedy shall be limited to replacement of any licensed software not meeting MSA-2000, Inc.’s limited warranty.

Except as stated above, the licensed software is provided “as is” without warranty of any kind, either expressed or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. In no event shall MSA-2000, Inc. be liable for loss of profit or any other commercial damage, including but not limited to special, incidental, consequential or other damages. Some states do not allow the exclusion of limitation of liability for incidental or consequential damages, in which case this limitation may not apply to you.

U.S. GOVERNMENT RESTRICTED RIGHTS

The Software, Software Copies and Related Materials are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subdivision (c)(1)(ii) of the Rights in Technical Data and Computer Software Clause at 48 CFR 252. 227-7013.
